Attorney General Jeff Jackson Urges Eligible North Carolinians to Claim Compensation for Certain Generic Drug Purchases

RALEIGH — Attorney General Jeff Jackson is urging eligible North Carolinians to claim the compensation they’re owed for overpaying for certain generic drugs.
Recently, a court preliminarily approved a plan by Attorney General Jackson and a coalition of 47 other states and territories to distribute funds from a series of settlements with drug manufacturers that allegedly conspired to raise generic drug prices. Affected customers nationwide will be eligible to receive restitution from several settlements, totaling $96.5 million.
Here’s what North Carolinians should do:
- Check the list here and confirm whether you purchased a generic drug on the list between May 2009 and December 2019.
- Call 1-866-290-0182, email info@AGGenericDrugs.com, or visit www.AGGenericDrugs.com to determine whether you are eligible for compensation.
- If you are eligible for compensation, submit a claim here.
“North Carolinians are getting money back to make up for unfairly high drug costs they paid in the past year,” said Attorney General Jeff Jackson. “We’re always going to hold companies accountable when they break the law and rig the system so they can charge people more.”
Attorney General Jackson and the coalition have reached settlements with Glenmark, Lannett, Bausch, Apotex, Heritage, and Heritage’s parent company, Emcure. The coalition is involved in a series of antitrust cases:
- The first complaint included Heritage and 17 other corporate defendants, two individual defendants, and 15 generic drugs.
- The second complaint was filed in 2019 against Teva Pharmaceuticals and 21 of the nation’s largest generic drug manufacturers. The complaint named 16 individual senior executive defendants.
- The third complaint, to be tried first, focuses on 80 topical generic drugs that account for billions of dollars of sales in the United States and names 26 corporate defendants and 10 individual defendants.
- The states filed a fourth complaint earlier this year, alleging that Novartis AG, Sandoz Group AG and Sandoz AG, are liable for Sandoz’s alleged conduct and for fraudulently transferring assets.
The complaints detail a web of competing industry executives who regularly communicated with each other. The complaints say the individuals met with each other during industry dinners, lunches, cocktail parties, golf outings, and “girls nights out.” Such meetings laid the foundation for their illegal agreements. The complaints note that defendants used terms like “fair share,” “playing nice in the sandbox,” and “responsible competitor” to unlawfully discourage competition, raise prices, and enforce an ingrained culture of collusion.
Attorney General Jackson is joined in announcing the distribution plans by Alaska, Arizona, California, Colorado, Connecticut, Delaware, District of Columbia, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Dakota, Northern Mariana Islands, Ohio, Oklahoma, Oregon, Pennsylvania, Puerto Rico, Rhode Island, South Carolina, South Dakota, Tennessee, U.S. Virgin Islands, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.
